Contract

This contract regulates the sale of new goods and services via the provider's online shop. Because of the details of the respective offer, reference is made to the product description on the offer page.
conclusion
The contract is concluded exclusively in electronic business transactions via the shop system. The offers shown represent a non-binding invitation to submit an offer through the customer order, which the provider can then accept. The ordering process for the conclusion of a contract in the shop system comprises the following steps:
• Selection of the offer in the desired specification (size, color, number)
• Place the offer in the shopping cart
• Press the 'order' button
• Enter the billing and delivery address
• Selection of the payment method
• Checking and processing the order and all entries
• Press the button 'order with costs'
• Confirmation email that the order has been received
• The contract is concluded when the order confirmation is sent.

Contract duration
The contract is concluded for an indefinite period.

Retention of title
The delivered goods remain the property of the provider until full payment has been made.
reservations
The provider reserves the right not to provide the promised service in the event of unavailability.

Prices, shipping costs, return shipping costs
All prices are final prices and include VAT. In addition to the final prices, depending on the shipping method, there are additional costs that are displayed before the order is sent. If there is a right of withdrawal and if this is used, the customer bears the costs of the return.

Terms of payment
The customer only has the following options for payment: advance transfer, payment service provider (PayPal). No other payment methods are offered and will be rejected.
After receipt of the invoice, which contains all the details for the transfer and is sent by email, the invoice amount must be transferred to the account specified there in advance. When using a fiduciary service / payment service provider, this enables the provider and the customer to process the payment among themselves. The escrow service / payment service provider forwards the customer's payment to the provider. Further information can be found on the website of the respective fiduciary service / payment service provider. The customer is obliged to pay or transfer the amount shown to the account specified on the invoice within 10 days of receipt of the invoice. Payment is due without deduction from the invoice date. The customer is only in default after a reminder.

Delivery terms
The goods will be dispatched immediately after receipt of payment. The dispatch takes place after 2 days at the latest. The entrepreneur undertakes to deliver on the 5th day after receipt of the order. The standard delivery time is 5 days unless otherwise stated in the item description. The provider sends the order from its own warehouse as soon as the entire order is in stock there. The customer will be informed of delays immediately. If the provider is not responsible for a permanent obstacle to delivery, in particular force majeure or non-delivery by its own supplier, even though a corresponding cover transaction was made in good time, the provider has the right to withdraw from a contract with the customer. The customer will be informed immediately and services received, in particular payments, will be refunded.

You have the right to cancel this contract within 30 days without giving any reason.

The cancellation period is 30 days from the day
◦ In the case of a sales contract: on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.
◦ In the case of a contract for several goods that the consumer has ordered as part of a single order and that are delivered separately: on which you or a third party named by you, who is not the carrier, has taken possession of the last goods ,
◦ In the case of a contract for the delivery of goods in several partial consignments or pieces: on which you or a third party named by you, who is not the carrier, has taken possession of the last partial consignment or the last piece.
◦ In the case of a contract for the regular delivery of goods over a specified period: on which you or a third party named by you, who is not the carrier, has taken possession of the first goods.
◦ When several alternatives come together, the last point in time is decisive.

In order to exercise your right of withdrawal, you must send us (my3dbase GmbH, Kristian Zimmermann, Roseggerstr. 21C, 85521 Ottobrunn 491732521326 info@my3dbase.com) a clear statement (e.g. a letter sent by post, fax, or email) Inform your decision to cancel this contract. You can use the attached sample cancellation form, but this is not mandatory.
To meet the cancellation deadline, it is sufficient for you to send your communication regarding your right of cancellation before the cancellation period expires.

Consequences of cancellation
If you cancel this contract, we have made all payments we have received from you, including delivery costs (with the exception of the additional costs that result from the fact that you chose a different type of delivery than the cheap standard delivery we offer) have) to repay immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. The deadline is met if you send off the goods before the period of 30 days has expired.
You bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the nature, properties and functionality of the goods.
Exceptions; Hygiene items, i.e. those that come into contact with food or items that need to be changed for installation (e.g. so-called 'remappers') are excluded from return.

Disclaimer
Claims for damages by the customer are excluded, unless otherwise stated for the following reasons. This also applies to the agent's representative and vicarious agent if the customer raises claims for damages against these. Claims for damages by the customer due to injury to life, limb, health or essential contractual obligations, which must be fulfilled in order to achieve the contractual objective, are excluded. Likewise, this does not apply to claims for damages after grossly negligent or willful breach of duty by the provider or his legal representative or vicarious agent.

Assignment and pledge ban
Claims or rights of the customer against the provider may not be assigned or pledged without the provider's consent, unless the customer has demonstrated a legitimate interest in the assignment or pledging.

Language, jurisdiction and applicable law
The contract is drawn up in German. The further implementation of the contractual relationship takes place in German. Only the law of the Federal Republic of Germany applies. This only applies to consumers insofar as it does not restrict the statutory provisions of the state in which the customer is domiciled or habitually resident. The place of jurisdiction for disputes with customers who are not consumers, legal entities under public law or special funds under public law is the location of the provider.

Severability clause
The ineffectiveness of a provision of these terms and conditions has no effect on the effectiveness of the other provisions.

Online settlement of consumer disputes (ODR regulation)
This so-called ODR regulation (Online Dispute Resolution) aims to create an independent, impartial, transparent, effective, quick and fair extrajudicial way of settling disputes. These disputes may result from the cross-border online sale of goods or the provision of services across the EU. The aim of this regulation is to be achieved by setting up an online dispute resolution platform (OS platform) at EU level and regulating cooperation with the national agencies for alternative dispute resolution.
